1. INTRODUCTION
These Terms and Conditions govern the relationship between Precious Gifts Early Learning Center (“the Centre”, “we”, “our”, or “us”) and the parent, guardian, or authorized caregiver (“Parent” or “Guardian”) enrolling a child in our care.
By enrolling a child at Precious Gifts Early Learning Center, the Parent confirms that they have read, understood, and agree to be bound by these Terms and Conditions.
2. OUR SERVICES
Precious Gifts Early Learning Center provides:
- Early childhood education and care
- Daycare services
- Structured learning programs
- Child development activities
- Daily supervision during operating hours
- Parent communication through the KidKonekt platform
- Attendance and pickup management
- Progress updates and reporting
3. ENROLLMENT REQUIREMENTS
Parents must provide:
- Completed registration forms
- Certified copy of the child’s birth certificate
- Parent/guardian identification documents
- Emergency contact information
- Medical information and allergies
- Immunization records where applicable
- Proof of residence
- Any additional documentation requested by the Centre
Parents are responsible for ensuring that all information provided remains accurate and up to date.
4. OPERATING HOURS
The Centre operates during the hours communicated to parents.
Children must be dropped off and collected within the designated operating times.
Repeated late collection may result in additional charges.
Parents must notify the Centre if another authorized person will collect a child.
5. FEES AND PAYMENTS
5.1 Payment Obligation
Parents agree to pay all fees associated with enrollment and attendance.
5.2 Due Dates
Fees are payable in advance on or before the due date communicated by the Centre.
5.3 Late Payments
Late payments may result in:
- Late payment penalties
- Suspension of services
- Restriction of access to reports or services
- Termination of enrollment
5.4 Outstanding Accounts
The Centre reserves the right to pursue recovery of outstanding amounts, including legal and collection costs where permitted by law.
6. ABSENCE POLICY
Regular attendance is encouraged.
Fees remain payable during:
- Illness-related absences
- Family holidays
- Public holidays
- Temporary closures beyond the Centre’s reasonable control
Unless otherwise agreed in writing.
7. HEALTH AND MEDICAL REQUIREMENTS
Parents must immediately disclose:
- Allergies
- Medical conditions
- Special care requirements
- Medication requirements
The Centre may refuse admission of a child who:
- Displays symptoms of contagious illness
- Has a fever
- Is medically unfit to attend
Parents may be contacted to collect a child who becomes ill during the day.
8. EMERGENCY MEDICAL TREATMENT
In the event of an emergency:
- The Centre will attempt to contact the Parent or emergency contacts.
- The Centre may seek medical assistance where necessary to protect the child’s health or safety.
Parents remain responsible for all medical expenses incurred.
9. CHILD SAFETY
The Centre takes reasonable steps to provide a safe and supervised environment.
Parents acknowledge that normal childhood activities involve inherent risks, including minor injuries resulting from play and participation in educational activities.
Nothing in these Terms excludes liability arising from gross negligence or unlawful conduct.
10. AUTHORIZED COLLECTION OF CHILDREN
Children will only be released to:
- Parents or legal guardians
- Individuals authorized in writing
- Persons recorded on the child’s profile
The Centre may request identification before releasing a child.
The Centre reserves the right to refuse release where safety concerns exist.
11. BEHAVIOR AND DISCIPLINE
The Centre promotes positive guidance and age-appropriate behavioral support.
Physical punishment, humiliation, intimidation, or degrading treatment will never be used.
Parents agree to cooperate with staff regarding behavioral development plans where required.
12. FOOD, ALLERGIES AND NUTRITION
Parents must notify the Centre of all food allergies or dietary restrictions.
The Centre will make reasonable efforts to accommodate dietary requirements but cannot guarantee an allergen-free environment.
Parents remain responsible for providing accurate allergy information.
13. PHOTOGRAPHS AND MEDIA
The Centre may take photographs or videos for:
- Educational records
- Classroom activities
- Child development documentation
- Parent updates through KidKonekt
Photographs will not be used for marketing purposes without appropriate consent where required.
14. KIDKONEKT PLATFORM
The Centre uses the KidKonekt platform for administration and communication.
Services may include:
- Parent communication
- Attendance tracking
- Pickup verification
- Invoicing and statements
- Payment records
- Child progress reporting
- Photo and activity sharing
Parents agree to:
- Maintain accurate account information
- Keep login credentials secure
- Use the platform responsibly
- Review notices and communications regularly
KidKonekt is a third-party platform used by the Centre to facilitate services and communications.
15. ELECTRONIC COMMUNICATIONS
Parents consent to receiving communications through:
- KidKonekt
- SMS
- Telephone calls
Communications sent through these channels shall be deemed received when transmitted.
16. PRIVACY AND DATA PROTECTION
The Centre collects and processes personal information for legitimate childcare, educational, administrative, and legal purposes.
Information may include:
- Parent details
- Child information
- Attendance records
- Medical information
- Payment records
- Photographs and activity records
The Centre processes personal information in accordance with applicable South African privacy legislation, including POPIA where applicable.
Information will not be sold or shared unlawfully.
17. INDEMNITY
Parents acknowledge that children participate in normal educational and recreational activities.
Parents agree that the Centre shall not be liable for ordinary risks associated with normal childhood activities, except where liability arises from gross negligence, willful misconduct, or unlawful conduct.
18. FORCE MAJEURE
The Centre shall not be liable for interruptions caused by circumstances beyond its reasonable control, including:
- Natural disasters
- Epidemics
- Government restrictions
- Utility failures
- Civil unrest
- Network or technology outages
19. TERMINATION OF ENROLLMENT
Either party may terminate enrollment by providing written notice in accordance with the Centre’s current notice requirements.
All outstanding fees remain payable upon termination.
The Centre may terminate enrollment immediately where:
- Fees remain unpaid
- False information was provided
- Safety concerns arise
- Parents repeatedly breach Centre policies
20. CHANGES TO TERMS
The Centre reserves the right to update these Terms and Conditions.
Updated versions will be communicated through KidKonekt, email, or other official communication channels.
Continued use of the Centre’s services constitutes acceptance of any revised Terms.
21. GOVERNING LAW
These Terms shall be governed by and interpreted in accordance with the laws of the Republic of South Africa.
Any disputes shall be subject to the jurisdiction of South African courts.
22. ACCEPTANCE
By signing the enrollment documentation or using the Centre’s services, the Parent confirms that they:
- Have read these Terms and Conditions;
- Understand them;
- Agree to be bound by them; and
- Consent to the use of KidKonekt for communication and administration purposes.
